The requirement applies to teaching appointments made on or after 2 September 2013.  The requirement was most clearly stated in the ‘Keeping children safe in Education’, it was inserted into the School Staffing (England) Regulations 2009 by virtue of the School Staffing (England) (Amendment) Regulations 2013.  While the amendment took effect on 1 September 2013, the accompanying explanatory note states the requirement to check whether a teacher is subject to a Prohibition Order applies to staff appointed on or after 2 September 2013.
