All governors are required to have an enhanced DBS check. Governors in academy schools should have these prior to appointment or as soon as possible thereafter.
The School Governance (Constitution and Federations) (England) (Amendment) Regulations 2016 which comes into force from 18th March 2016 makes it a requirement for maintained schools.
For any governor elected or appointed before 1st April 2016 who does not hold an enhanced DBS check certificate, the governing body must apply for such a certificate in respect of that governor by 1st September 2016.
Where a governor is elected or appointed on or after 1st April 2016 and does not hold an enhanced DBS certificate, the governing body must apply for such a certificate in respect of that governor within 21 days after his or her appointment or election.
